Terms of service

1. What Craterborn is

Craterborn is a free browser game. The service is provided by Michał Sikora, Aleja Reymonta 21 m. 255, 01-840 Warsaw, Poland, contact: kontakt@craterborn.com.

To play you need a browser with WebGL support and an internet connection. You do not have to provide any personal data — choosing a character name is enough.

For breaching these rules we may restrict access to the service or delete the account. For serious breaches — without warning.

4. Availability of the service

The game is in testing. We do not guarantee continuous availability or that progress will be preserved. The server is taken down at times, and data may be wiped during larger changes. We will announce planned progress wipes in the game.

We reserve the right to change the rules, balance and content of the game, and to suspend or discontinue the service. Should we shut the service down for good, we will give at least 30 days' notice.

5. In-game currency and items

Currency, items and characters exist only inside the game. They are not your property and have no value outside the game. They must not be sold, traded or transferred outside the game for money or other benefits.

5a. Gems and the season pass

Sales are not live yet. This section describes the rules that will apply once they are switched on. Until then nothing in the game can be bought.

Gems are a currency bought with money. They cannot be earned by playing. Gems buy only the season pass, which grants character appearance and returns part of the gems. Gems cannot buy anything that affects gameplay — no gear, stats, upgrades or crafting materials.

The pass runs for one calendar month. Levels come from daily contracts. When the season ends progress resets, but everything you have unlocked stays yours forever — as do unspent gems, which do not expire.

Pass rewards are claimed by you. A reward left unclaimed when the season ends is lost with the season; levels do not carry over to the next pass.

5b. Right of withdrawal and consent to immediate performance

Buying gems or the pass is the supply of digital content not supplied on a tangible medium.

As a consumer you generally have the right to withdraw from the contract within 14 days without giving a reason. For digital content that right is lost if performance began with your express prior consent and with your acknowledgement that you thereby lose the right of withdrawal (Art. 16(m) of the Consumer Rights Directive 2011/83/EU, implemented in Poland by Art. 38(1)(13) of the Consumer Rights Act).

Before every purchase we therefore ask you to tick a statement reading:

"I request immediate delivery of the digital content and acknowledge that I lose my right of withdrawal once it has been delivered."

Without that consent the purchase does not go through. If you do not tick it, the gems are delivered only after 14 days have passed, or the purchase is cancelled — the choice is yours.

The consent concerns the right of withdrawal only. It does not limit your rights where the digital content does not conform to the contract — if the gems or the pass do not work as described, you may complain under section 8.

Purchases made through a platform store (App Store, Google Play) are settled by that platform and its refund rules take precedence there.

5c. Who sells and who processes the payment

Gems are sold by Lemon Squeezy, LLC acting as the merchant of record. This means your purchase contract for the gems is with them, not directly with us — and they are responsible for VAT and sales tax, and for handling refunds and payment disputes.

You enter your card details on their page and they never reach us in any form — we have no access to them and do not store them.

On your card statement the charge appears with the prefix LEMSQZY* followed by the store name, not as "Craterborn". If you do not recognise a charge, that is what it is.

The game itself is run by us — details in section 1. Complaints about how gems and the season pass behave IN GAME go to us; anything about payment, invoices or refunds goes to Lemon Squeezy.

Gems are credited automatically, usually within seconds of the payment clearing. With delayed payment methods (e.g. bank transfer) delivery follows once the funds arrive. If gems have not appeared an hour after payment, write to the contact address with the date of purchase — the store's payment confirmation is enough for us to find the transaction.

6. Leaving

You may stop using the game at any time. You can delete the account in the game settings or by writing to the contact address. Deletion is irreversible.

7. Liability

The service is free and provided as is. To the extent permitted by law we are not liable for loss of in-game progress, downtime, or damage arising from use of the game.

The limitation above does not exclude liability for damage caused intentionally, nor any liability that cannot be excluded by law — in particular towards consumers.

8. Complaints

Send complaints to the contact address above. We will answer within 14 days. As a consumer you may also use out-of-court dispute resolution, including mediation at the regional Trade Inspection authorities in Poland, or the dispute resolution bodies available in your own country of residence.

9. Personal data

How we process data is described in the Privacy policy.

10. Changes to these terms

We will announce changes in the game at least 14 days before they take effect. Continuing to use the game after that date means accepting the new version. If you do not agree with it — you can delete the account.

11. Governing law

Matters not covered here are governed by Polish law. These terms do not limit consumer rights arising from mandatory provisions of law, including those of your country of habitual residence.
